Tehran - Algiers - Washington way....

"The Algiers Accords of January 19, 1981, were brokered by the Algerian government between the United States and Iran to resolve the Iran hostage crisis. The crisis arose from the takeover of the American embassy in Tehran on November 4, 1979, and the taking hostage of the American staff there. By this accord the 52 American citizens were set free and able to leave Iran." (Wikipedia)

White endings - Blue beginnings

Paris under its white coat again.... No need to complain, I feel it's only winter trying to strike back as it knows it is almost over.

Last time it snowed  in Paris was the lovieliest day of 2013. For me anyway. Nothing to do with the winter; just a coincidence. Just an encouter, a perfect time and a perfect place. We are evolving through the sign of Pisces and it is a great time, according to me, in between areas, moving towards new beginnings.

In a couple of weeks, it will be spring in Europe. In Nairobi, summer will lead into the short rain season. In the Iranian calender, it will be Nowruz, the new year...

Kenya - Updates

1. Kenya has a new President-elect... Normally.

Uhuru Kenyatta should be Keny's fourth President from March 26, unless the outgoing Prime Minister contests the results at the Supreme Court, as he declared he would...

2. The ICC just announced it is dropping charges against Francis Muthaura

Declaration here:

Statement by ICC Prosecutor on the Notice to withdraw charges against Mr Muthaura

Ladies and Gentlemen, People of Kenya:

Firstly, I wish to sincerely commend all Kenyans for their commitment to maintaining peace during this election.

I wish to inform you, that today I filed a notice to the Judges to withdraw charges against Mr. Francis Kirimi Muthaura.  I have done so after carefully considering all the evidence available to me at this time. It is my duty to proceed only when I believe that there is a reasonable prospect of conviction at trial.   If not, then it is my responsibility as Prosecutor to take the decision to withdraw the charges.
This is an exceptional decision.  I did not take it lightly, but I believe it is the right thing to do.
I explained to the Judges the reasons for my decision, specifically, the severe challenges my Office has faced in our investigation of Mr. Muthaura;
 - the fact that several people who may have provided important evidence regarding Mr Muthaura’s actions, have died, while others are too afraid to testify for the Prosecution.
- the disappointing fact that the Government of Kenya failed to provide my Office with important evidence, and failed to facilitate our access to  critical witnesses who may have shed light on the Muthaura case.
- the fact that we have decided to drop the key witness against Mr. Muthaura  after this witness recanted a crucial part of his evidence, and admitted to us that he had accepted bribes.
Let me be absolutely clear on one point – this decision applies only to Mr. Muthaura.  It does not apply to any other case.

My decision today is based only on the specific facts of the case against Mr. Muthaura, and not on any other consideration.  While we are all aware of political developments in Kenya, these have no influence, at all, on the decisions that I make as Prosecutor of the International Criminal Court.  As I have consistently underscored, the International Criminal Court is a judicial institution.

In conclusion, let me remind you all of my unwavering commitment to justice for the victims of the 2007-2008 post-election violence.  The real victims of the terrible violence in Kenya five years ago are the men, the women, and the children, who were killed, injured, raped, or forcibly displaced from their homes - and whose voices must not be forgotten.

VOTE IN KENYA

"In Kenya, democracy triumphs, but justice fails"

Kenyatta, Kenya's President-elect

An editorial and a comment:

Kenya: president as defendant

The west, and Britain in particular, should beware of giving Kenyans finger-wagging lectures on democracy

Kenyans elected a president we felt could bring peace

Uhuru Kenyatta will be more defiant, too. We learned during our crisis the risk of being banana-republicked by the west

Poetry lines: Moscow - Paris via Mecca

"Encore et encore.
Pour vous je suis
L’étoile.
Malheur au marin qui mal prit
Le cap de sa voile
Vers l’étoile:
Il se brisera aux écueils
Aux fonds sous-marins.
Malheurs à vous qui prîtes
Le cap de vos cœurs vers moi:
Vous vous briserez aux pierres
Et les pierres riront
De vous.
Comme vous avez ri
De moi."

Leçons de vie

"A toute chose, malheur est bon ?"

Proverbe français

--

Kenya: ICC on Kenyatta / Ruto trial

Ruto and Sang case: The trial opening is postponed to 28 May 2013

Situation: Kenya
Case: The Prosecutor v. William Samoei Ruto and Joshua Arap Sang

Today, 8 March 2013, Trial Chamber V of the International Criminal Court (ICC) decided to grant the Defence teams’ requests, to which the Prosecutor did not oppose, and to postpone the opening of the trial in the case The Prosecutor v. William Samoei Ruto and Joshua Arap Sang. The Chamber vacated the trial commencement date of 10 April and set the new date for 28 May 2013.

The Chamber considers that it is important to ensure that the accused have adequate time for the preparation of the defence, hence it grants the Defence additional time to continue its investigations and prepare for trial. However, the Chamber is of the view that the postponement need not be as long as requested by the Defence. The Chamber considers it sufficient to vacate the trial date until 28 May 2013, which should give the Defence adequate additional time to prepare for trial.

Yesterday, the same Chamber postponed the opening of the trial in the case The Prosecutor v. Francis Kirimi Muthaura and Uhuru Muigai Kenyatta and set the new date provisionally for 9 July 2013.
